1. TERMS AND CONDITIONS

1.1 Introduction

Welcome to LawyerMart ("LawyerMart", "we", "us", or "our"), a brand operated by Ayrus Ventures LLP.

These Terms and Conditions govern your access to and use of lawyermart.in ("Website") and your purchase, possession, and use of products offered through the Website ("Products").

By accessing the Website, placing an order, making payment, submitting personalization information, or otherwise purchasing a Product from us, you acknowledge that you have had access to and agree to be bound by these Terms and Conditions and other applicable policies published on the Website.

Nothing contained in these Terms and Conditions is intended to exclude, restrict, or waive any right or remedy that cannot lawfully be excluded, restricted, or waived under applicable Indian law.


1.2 Products

LawyerMart may sell products including, without limitation:

  • Pens and writing instruments;
  • Diaries and notebooks;
  • Power-bank diaries and electronic accessories;
  • Lamps;
  • Card holders;
  • Pen stands and desk accessories;
  • LED name plates;
  • Door name plates;
  • Desk name plates;
  • Car hangings and accessories;
  • Hoodies and apparel;
  • Décor articles;
  • Personalized and customized gifts; and
  • Other professional, office, gifting, lifestyle, decorative, and personalized products.

Products may be manufactured by Ayrus Ventures LLP, assembled or personalized by us, sourced from third-party manufacturers or suppliers, or comprise a combination of components sourced from multiple suppliers.


1.3 Product Information and Representation

We make reasonable efforts to accurately display Product descriptions, dimensions, specifications, photographs, colours, materials, features, and other information.

However, actual Products may have reasonable variations resulting from:

  • Screen and display settings;
  • Lighting and photography;
  • Manufacturing tolerances;
  • Natural variations in wood, stone, leather, fabric, acrylic, metal, and other materials;
  • Printing, engraving, embroidery, cutting, fabrication, or manufacturing processes;
  • Hand-finishing;
  • Batch-to-batch variations;
  • Supplier or component variations; or
  • Customization and personalization processes.

Such reasonable variations shall not, by themselves, constitute a Product defect.

Colours displayed on electronic screens may differ from the actual Product due to differences in screen calibration, brightness, photography, and lighting.

Product dimensions displayed on the Website may be approximate unless expressly stated otherwise.


1.4 Order Acceptance

An order placed on the Website constitutes an offer by the customer to purchase the selected Product.

Receipt of an order confirmation does not necessarily constitute final acceptance of the order.

We reserve the right to accept or reject an order before dispatch for legitimate reasons, including:

  • Product unavailability;
  • Pricing or listing errors;
  • Payment verification issues;
  • Suspected fraudulent activity;
  • Incomplete personalization information;
  • Unserviceable delivery locations;
  • Intellectual property concerns regarding customer-submitted content;
  • Technical errors; or
  • Operational limitations.

If a prepaid order is cancelled by us before dispatch, the amount collected for the cancelled Product will be refunded through an appropriate payment method.


2. PERSONALIZATION AND CUSTOMIZATION POLICY

2.1 Customer Responsibility

Customers are responsible for ensuring that all information submitted for personalization or customization is complete and correct.

This includes, without limitation:

  • Names;
  • Spellings;
  • Titles;
  • Professional designations;
  • Advocate or professional details;
  • Dates;
  • Initials;
  • Messages;
  • Addresses;
  • Photographs;
  • Logos;
  • Symbols;
  • Artwork; and
  • Any other information or content submitted by the customer.

Where a Product is produced according to information supplied by the customer, LawyerMart shall not be responsible for errors that accurately reproduce incorrect information submitted or approved by the customer.

Customers are strongly advised to carefully check all personalization information before submitting an order.


2.2 Proofs and Approvals

Where LawyerMart provides a digital design proof, preview, mock-up, or other representation for customer approval, the customer must carefully review all elements before approving the design.

Customer approval constitutes authorization for LawyerMart to proceed with production based on the approved design.

Once a design has been approved and production has commenced, changes or cancellations may not be possible.

If LawyerMart manufactures or personalizes a Product differently from the customer's final approved proof in a material respect due to an error attributable to LawyerMart, the customer may be eligible for correction, repair, replacement, or another appropriate remedy in accordance with applicable law and our policies.


2.3 Orders Without Design Proofs

Certain Products may be personalized directly using information submitted by the customer without a separate design proof.

For such Products, the customer is solely responsible for checking the accuracy of the personalization information before submitting the order.

LawyerMart shall not be responsible for accurately reproducing incorrect information submitted by the customer.


2.4 Customer-Supplied Content

By submitting any logo, photograph, artwork, trademark, trade name, text, symbol, image, or other content for personalization, the customer represents that they possess all necessary rights, licences, permissions, consents, or authorisations required for its reproduction and use.

To the extent permitted by applicable law, the customer shall be responsible for claims arising directly from content supplied by the customer where such claims result from the customer's lack of necessary rights, permission, or authorization.

LawyerMart reserves the right to refuse to reproduce content that it reasonably believes is unlawful, infringing, defamatory, hateful, obscene, fraudulent, misleading, or otherwise inappropriate.


3. CANCELLATION AND ORDER MODIFICATION POLICY

3.1 Personalized Products

Personalized, customized, or made-to-order Products may only be cancelled or modified before production or personalization has commenced.

Once production, printing, engraving, embroidery, cutting, fabrication, customization, or personalization has commenced, cancellation or modification may not be possible.


3.2 Standard Products

Cancellation requests for non-personalized Products may be accepted before dispatch, subject to the order status and applicable law.

Once a Product has been dispatched, cancellation may no longer be possible and any available return rights will be governed by the Return, Refund and Replacement Policy.


3.3 Requesting Changes

Customers who wish to cancel or modify an order should contact LawyerMart immediately using the customer support details displayed on the Website.

Submitting a cancellation or modification request does not guarantee that the requested change can be made.

A modification or cancellation shall be considered confirmed only when LawyerMart expressly confirms acceptance of the request.


4. RETURN, REFUND AND REPLACEMENT POLICY

4.1 Personalized Products

Because personalized, customized, and made-to-order Products are produced specifically according to customer requirements, such Products may not be eligible for return, refund, or exchange solely due to:

  • Change of mind;
  • Personal preference;
  • Incorrect information supplied by the customer;
  • Incorrect spelling supplied or approved by the customer;
  • Customer dissatisfaction with a design previously approved by the customer; or
  • Reasonable variations in colour, texture, grain, finish, dimensions, or appearance resulting from materials or manufacturing processes.

This does not affect remedies available under applicable law for Products that are genuinely defective, materially damaged before delivery, materially different from the confirmed order, or incorrectly personalized due to an error attributable to LawyerMart.


4.2 Reporting a Damaged, Defective, or Incorrect Product

Customers should report any alleged damaged, defective, or incorrect Product within 1 day(s) of delivery.

Customers may be requested to provide:

  • Order number;
  • Photographs of the Product;
  • Photographs of the packaging;
  • A video demonstrating the alleged defect where reasonably necessary;
  • A description of the issue; and
  • Any other information reasonably required to assess the claim.

Customers should retain the Product and, where reasonably possible, the original packaging until the claim has been assessed.

Failure to provide requested information may affect our ability to verify a claim but shall not extinguish any statutory right that cannot lawfully be waived.


4.3 Remedies for Verified Defects

Where LawyerMart verifies that a Product is defective, materially damaged, incorrect, or materially inconsistent with the confirmed order, LawyerMart may, as appropriate and subject to applicable law:

  1. Repair the affected Product;
  2. Replace the affected Product or component;
  3. Correct the personalization;
  4. Provide a replacement Product; or
  5. Provide a refund where repair, correction, or replacement is unavailable, impractical, or otherwise required under applicable law.

The appropriate remedy will depend on the nature of the Product, nature and extent of the defect, availability of replacement Products or components, and applicable legal requirements.


4.4 Normal Wear and Tear

Damage resulting from normal wear and tear shall not, by itself, constitute a manufacturing defect.

This may include:

  • Scratches arising through ordinary use;
  • Fading over time;
  • Natural discolouration;
  • Wear of printed, engraved, embroidered, or finished surfaces;
  • Battery capacity degradation over time;
  • Natural deterioration of materials;
  • Damage resulting from environmental exposure; or
  • Other deterioration caused by ordinary ageing and use of the Product.

5. PRODUCT WARRANTY POLICY

Unless a specific Product page expressly provides a separate written commercial warranty, no additional commercial warranty is provided beyond remedies required under applicable law and the remedies expressly stated in these policies.

Where a Product-specific warranty is expressly offered, such warranty shall apply only for the period and under the conditions stated on the relevant Product page or accompanying warranty documentation.

To the extent permitted by applicable law, warranty or replacement coverage may not apply to damage caused by:

  • Misuse;
  • Accidents;
  • Negligence;
  • Improper storage;
  • Improper installation;
  • Unauthorized modification;
  • Unauthorized repair;
  • Use contrary to supplied instructions or warnings;
  • Normal wear and tear;
  • Water or moisture exposure where the Product is not represented as waterproof or water-resistant;
  • Excessive heat;
  • Fire;
  • Electrical surges or fluctuations;
  • Physical impact;
  • Crushing or puncturing;
  • Use of incompatible chargers, adapters, cables, batteries, or power sources; or
  • Other external causes unrelated to an inherent Product defect.

Nothing contained in this Policy limits any statutory right that cannot lawfully be excluded or restricted.


6. PRODUCT SAFETY AND PROPER USE POLICY

Customers are responsible for using Products only for their intended purpose and in accordance with any instructions, warnings, labels, care information, and reasonable safety precautions applicable to the Product.

Customers should inspect Products before use and discontinue use where a Product shows visible signs of damage, malfunction, or any condition that may reasonably make continued use unsafe.


6.1 Pens and Writing Instruments

Pens and writing instruments should be securely capped or retracted before being placed in pockets, bags, purses, luggage, or near clothing and other valuable property.

Customers should periodically inspect writing instruments for visible leakage, cracks, damage, or other abnormalities.

Pens should not be stored in conditions of excessive heat or pressure that may reasonably increase the risk of ink leakage.

If leakage or physical damage is observed, use of the Product should be discontinued.


6.2 Power Banks and Power-Bank Diaries

Customers must follow all charging, storage, and usage instructions supplied with the Product.

Only compatible and appropriate charging equipment should be used.

Customers must immediately discontinue use if a Product exhibits:

  • Unusual or excessive heat;
  • Swelling;
  • Deformation;
  • Unusual odour;
  • Smoke;
  • Leakage;
  • Physical damage; or
  • Other abnormal behaviour.

Electronic Products and batteries should not be exposed to water, fire, excessive heat, puncture, crushing, unauthorized modification, or other conditions that may damage the Product.

Customers should not continue using a Product after observing signs that may indicate a potential safety issue.


6.3 Lamps and LED Products

Electrical and LED Products must be used only with compatible power supplies and within specified electrical ratings.

Customers should not use visibly damaged cables, adapters, connectors, plugs, or other electrical components.

Products intended for indoor use should not be used outdoors or exposed to water or excessive moisture unless expressly represented as suitable for such conditions.

Customers should discontinue use of an electrical Product that exhibits abnormal heating, smoke, burning smell, sparks, damaged wiring, or other signs of malfunction.


6.4 Name Plates and Mounted Products

Customers are responsible for selecting a mounting or installation method suitable for the relevant wall, door, desk, surface, or installation location unless installation is expressly performed by LawyerMart.

Adhesive strength and mounting suitability may vary depending on:

  • Surface material;
  • Surface cleanliness;
  • Paint or coating quality;
  • Temperature;
  • Humidity;
  • Installation technique;
  • Weight of the Product; and
  • Environmental conditions.

Where mounting or installation instructions are provided, customers should follow them carefully.

Customers should periodically check mounted Products where failure of the mounting system could reasonably cause injury or property damage.


6.5 Car Hangings and Vehicle Accessories

Car hangings and vehicle accessories must be positioned and used in a manner that does not:

  • Obstruct the driver's visibility;
  • Interfere with steering or vehicle controls;
  • Interfere with airbags or safety systems;
  • Distract the driver; or
  • Otherwise create an unsafe driving condition.

The customer is responsible for ensuring that the Product is installed and used safely and in accordance with applicable road and vehicle requirements.


6.6 Hoodies and Apparel

Customers should follow all washing and care instructions supplied with the Product.

Damage caused by washing, drying, ironing, bleaching, dry cleaning, or other treatment contrary to the applicable care instructions may not constitute a Product defect.

Minor colour variations may occur between digital images and actual fabric.


7. LIMITATION OF LIABILITY

7.1 Primary Remedy for Defective Products

Subject to applicable law, where a Product supplied by LawyerMart is established to be defective, LawyerMart's primary contractual obligation shall be, at its discretion and as appropriate, to:

  • Repair the affected Product;
  • Replace the affected Product or component;
  • Correct the defect or personalization; or
  • Refund the purchase price paid for the affected Product.

7.2 Exclusion of Indirect and Consequential Loss

To the maximum extent permitted by applicable law, Ayrus Ventures LLP and LawyerMart shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage arising from or relating to the purchase, possession, storage, installation, handling, or use of a Product.

To the maximum extent permitted by applicable law, this exclusion includes indirect, incidental, or consequential loss or damage relating to:

  • Clothing;
  • Bags;
  • Furniture;
  • Walls or surfaces;
  • Vehicles;
  • Electronic devices;
  • Business materials;
  • Documents;
  • Personal belongings; or
  • Other property.

7.3 Monetary Limitation of Contractual Liability

To the maximum extent permitted by applicable law, the aggregate contractual liability of Ayrus Ventures LLP arising from or relating to an order shall not exceed the amount actually paid by the customer for the specific Product giving rise to the claim.

This limitation shall not apply to any liability that cannot lawfully be excluded, restricted, or limited under applicable law.


7.4 Mandatory Legal Rights

Nothing contained in these Terms or Policies shall exclude, restrict, or limit:

  • Any liability that cannot lawfully be excluded or limited;
  • Any statutory consumer right that cannot lawfully be waived;
  • Any liability imposed under applicable product liability law that cannot lawfully be excluded by contract; or
  • Any other mandatory legal obligation applicable to Ayrus Ventures LLP.

7.5 Customer Responsibility to Prevent Further Damage

Where a customer becomes aware of a Product defect, malfunction, leakage, overheating, physical damage, or other potentially unsafe condition, the customer should discontinue use where continued use could reasonably increase the risk of damage.

The customer should take reasonable steps to prevent avoidable additional loss or damage after becoming aware of the issue.


7.6 Claims Relating to Additional Property Damage

Where a customer alleges that a Product has caused damage to clothing, personal belongings, furniture, vehicles, electronic devices, property, or any other item, LawyerMart reserves the right to reasonably investigate the circumstances of the claim before determining responsibility or providing any remedy.

The customer may be requested to:

  • Provide photographs or videos of the allegedly defective Product;
  • Provide photographs or videos of the alleged damage;
  • Provide details regarding the circumstances in which the alleged damage occurred;
  • Provide reasonable evidence of the value of the allegedly damaged property;
  • Retain the Product for inspection;
  • Return the Product for examination where reasonably required; and
  • Provide other information reasonably necessary to investigate the claim.

No request for information or investigation by LawyerMart constitutes an admission of liability.

Any liability arising from such a claim shall be determined in accordance with these Terms and applicable law.


8. THIRD-PARTY MANUFACTURED AND SOURCED PRODUCTS

Certain Products or components sold through LawyerMart may be manufactured or supplied by third parties.

LawyerMart may personalize, customize, print, engrave, package, assemble, bundle, market, distribute, or resell such Products.

Where applicable, a manufacturer's warranty may apply in addition to rights available to the customer against LawyerMart.

Nothing in this section is intended to disclaim or exclude any responsibility that applicable law imposes directly upon Ayrus Ventures LLP or LawyerMart as a product seller or otherwise.

LawyerMart reserves all rights to pursue remedies against manufacturers, suppliers, distributors, or other responsible third parties where a claim arises from a defect or issue attributable to such third party.


9. SHIPPING AND DELIVERY POLICY

Delivery and dispatch dates displayed or communicated by LawyerMart are estimates unless expressly stated to be guaranteed.

Delivery or dispatch delays may occur due to circumstances including:

  • Courier operations;
  • Weather conditions;
  • Natural disasters;
  • Government restrictions;
  • Strikes;
  • Festivals or peak periods;
  • Remote delivery locations;
  • Incorrect or incomplete addresses;
  • Customer unavailability;
  • Transportation disruptions;
  • Supply-chain disruptions; or
  • Other circumstances reasonably outside LawyerMart's control.

Customers are responsible for providing a complete and accurate delivery address and valid contact information.

If an order is returned due to an incorrect or incomplete address, refusal of delivery, repeated failed delivery attempts, or customer unavailability, re-shipping may be subject to additional shipping charges where legally permissible.


10. CASH ON DELIVERY POLICY

Cash on Delivery ("COD") may be available for eligible Products, delivery locations, customers, and order values.

LawyerMart reserves the right to restrict or refuse COD availability for legitimate business reasons, including:

  • Personalized or customized Products;
  • High-value orders;
  • Locations with high delivery failure rates;
  • Customers with a history of repeated refused or undelivered orders;
  • Orders requiring advance payment for customization; or
  • Reasonable fraud or operational risk considerations.

LawyerMart may contact customers to confirm COD orders before commencing production or dispatch.

Failure to confirm an order where confirmation is reasonably required may result in processing being delayed or the order being cancelled.


11. INTELLECTUAL PROPERTY POLICY

All LawyerMart-owned Website content, branding, logos, original Product photographs, graphics, designs, Website copy, layouts, and other proprietary materials are protected by applicable intellectual property laws.

No person may reproduce, commercially exploit, distribute, copy, modify, or use LawyerMart-owned intellectual property without appropriate authorization.

Third-party trademarks, logos, professional marks, or other intellectual property reproduced on customized Products at a customer's request remain the property of their respective owners.

The availability of personalization or customization services does not imply that LawyerMart is affiliated with, sponsored by, endorsed by, or authorized by any third-party trademark or intellectual property owner.


12. PRICING AND PAYMENT POLICY

Prices displayed on the Website are subject to change from time to time.

The price applicable to an accepted order will ordinarily be the price confirmed at checkout, subject to correction of obvious or genuine pricing, typographical, or technical errors before fulfilment.

If an order cannot reasonably be fulfilled due to a material pricing or technical error, LawyerMart may cancel the affected order and refund any amount collected for the cancelled Product.

Available payment methods may include prepaid online payments and Cash on Delivery, subject to eligibility.


13. FORCE MAJEURE

To the extent permitted by applicable law, LawyerMart shall not be responsible for delays or failures in performance caused by circumstances reasonably beyond its control.

Such circumstances may include natural disasters, fire, flood, epidemic, pandemic, war, civil disturbance, government restrictions, transportation disruption, telecommunications failure, widespread power outages, strikes, courier disruption, or major supply-chain disruption.

Nothing in this provision affects any refund or other mandatory obligation that may arise under applicable law.


14. GOVERNING LAW AND JURISDICTION

These Terms and Policies shall be governed by and interpreted in accordance with the laws of India.

Subject to any mandatory rights of consumers to approach a competent Consumer Commission, court, tribunal, or other authority having jurisdiction under applicable law, disputes arising from or relating to these Terms, the Website, or transactions with LawyerMart shall be subject to the jurisdiction of competent courts at Delhi only.

Nothing in this clause shall restrict a consumer from approaching any forum that has mandatory jurisdiction under applicable law.


15. PRIVACY POLICY

Ayrus Ventures LLP, through LawyerMart, may collect personal data reasonably necessary for operating the Website, processing transactions, fulfilling orders, providing services, and communicating with customers.

Information collected may include:

  • Name;
  • Telephone number;
  • Email address;
  • Billing address;
  • Shipping address;
  • Order information;
  • Personalization information;
  • Customer communications;
  • Payment transaction references;
  • Device and Website usage information;
  • Photographs;
  • Logos;
  • Artwork; and
  • Other content voluntarily submitted for personalization or customization.

Personal data may be processed for lawful purposes including:

  • Processing and fulfilling orders;
  • Manufacturing and personalizing Products;
  • Delivering orders;
  • Providing customer support;
  • Processing cancellations, returns, replacements, and refunds;
  • Preventing fraud and misuse;
  • Maintaining accounting, tax, and business records;
  • Managing complaints and claims;
  • Sending transactional communications;
  • Improving Website functionality and customer experience; and
  • Sending marketing communications where permitted and subject to applicable consent requirements.

Information may be shared, where reasonably necessary and subject to applicable law, with third-party service providers involved in operating the business.

Such service providers may include:

  • E-commerce technology providers;
  • Payment processors and payment gateways;
  • Banks and financial service providers;
  • Logistics and courier companies;
  • Communication and messaging service providers;
  • Customer support providers;
  • Analytics providers;
  • Advertising and marketing technology providers;
  • Cloud storage and hosting providers;
  • Professional advisers; and
  • Government or regulatory authorities where disclosure is required by law.

Ayrus Ventures LLP does not sell customers' personal data as a standalone commercial product.

Personal data will be retained only for as long as reasonably necessary for the purposes for which it was collected or as required under applicable law.

Customers may contact connect@lawyermart.in regarding applicable privacy rights, requests, or concerns.

Ayrus Ventures LLP will process personal data in accordance with applicable Indian data-protection and privacy laws.


16. GRIEVANCE REDRESSAL

Customers may submit grievances regarding orders, Products, payments, refunds, replacements, Website services, or other concerns using the details shared at the top.


Complaints and grievances will be acknowledged and handled within timelines required under applicable law.

Customers are requested to include their order number and sufficient information regarding the matter to enable the grievance to be investigated and addressed.


17. CHANGES TO THESE TERMS AND POLICIES

LawyerMart may update these Terms and Policies from time to time to reflect changes in applicable law, business operations, Products, services, technology, or regulatory requirements.

The updated version will be published on the Website with an updated effective date.

Changes to these Terms and Policies will not retrospectively remove or restrict rights that have already accrued to a customer under applicable law.


18. GENERAL PRODUCT DISCLAIMER

Product images displayed on the Website are for representation purposes.

Minor variations in colour, texture, grain, finish, dimensions, and appearance may occur due to screen settings, materials, photography, lighting, manufacturing, and personalization processes.

Customers must carefully review all personalization information before placing an order or approving a design.

Personalized Products may not be eligible for return, cancellation, or exchange once production has commenced, except where required under applicable law or where a Product is defective or incorrectly produced due to an error attributable to LawyerMart.

Customers must use Products only for their intended purpose and follow applicable safety, usage, installation, and care instructions.


19. ELECTRONIC AND ELECTRICAL PRODUCT SAFETY NOTICE

The following applies to power banks, power-bank diaries, LED Products, lamps, and other relevant electrical or electronic Products.

Use Products only with compatible charging and power equipment.

Keep electrical and electronic Products away from water, fire, excessive heat, and conditions likely to cause physical damage.

Do not puncture, crush, improperly modify, disassemble, or attempt unauthorized repairs.

Discontinue use immediately if you notice swelling, excessive heat, unusual odour, smoke, leakage, deformation, damaged wiring, sparks, or other abnormal behaviour.

Follow all Product-specific instructions and warnings supplied with the Product.


20. PEN AND WRITING INSTRUMENT NOTICE

Ensure that pens and writing instruments are properly capped or retracted before placing them in clothing, pockets, bags, luggage, or near valuable property.

Avoid exposing writing instruments to excessive heat or other conditions that may cause ink leakage.

Periodically inspect the Product for visible leakage, cracks, or physical damage.

Discontinue use if leakage or damage is observed.


21. ACCEPTANCE OF TERMS

By completing a purchase through LawyerMart, the customer acknowledges that they have had reasonable access to the Terms and Conditions and applicable policies published on the Website.

If any provision contained in these Terms or Policies is determined by a competent authority to be invalid or unenforceable, such provision shall, to the extent possible, be severed or limited without affecting the validity or enforceability of the remaining provisions.

Nothing contained in these Terms or Policies shall override any mandatory protection or statutory right available to a consumer under applicable Indian law.

 

22. CUSTOMER INFORMATION AND ACCOUNT RESPONSIBILITY

Customers may be required to provide certain information to access or use certain features of the Website or to purchase Products, including name, email address, telephone number, billing information, payment information, shipping information, and personalization details.
